| The 10KScholarship Scholarship Contest ("Contest") is open only to legal residents of the fifty (50) United States and the District of Columbia who are seventeen (17) years of age or older. Employees, officers and directors of Sponsor and each of its related companies and agents, as well as the immediate family (defined as parents, spouse, children, siblings and grandparents) and household members of each such employee, officer and director are not eligible to enter. All federal, state and local laws and regulations apply. By participating in the Contest, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding. | SCHOLARSHIP CONTEST PERIOD: |
| The current Scholarship contest period began on January 1st, 2009 at 12:00 AM ET and will end on December 31st, 2009 at 11:59 P.M. ET. The drawing for the scholarship award will take place on or about January 15th, 2010. |
| HOW TO ENTER: |
| During the Contest Period, go to www.10kscholarship.com and follow the links and instructions to register for free. You must complete the registration process, select the format for your Confirmation Email, and retain a copy of the Confirmation Email that is sent to you. By registering, you will be able to access the Scholarship Search Tool online and download the informative Directory of Scholarship Websites at no charge, which contains links and information on thousands of websites that provide scholarships, or scholarship information. Limit: one (1) entry per person per Contest Period. However, by using the Tell-A-Friend functionality, you may earn one (1) additional entry for each different friend you tell about our website, for a total of up to three (3) additional entries per person. Any use of automatic, programmed or similar entry methods or agents (including but not limited to sweepstakes entry services) will void all entries by that entrant. Proof of entry submission will not be deemed to be proof of receipt by Sponsor. Entries will be acknowledged with a confirmation email, which must be saved and submitted by the potential winners upon notification of selection. All entrants must submit a valid email and postal address. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, technically corrupted or misdirected entries, all of which will be disqualified. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed the entrant. The "authorized account holder" is the natural person assigned to the email address by the organization responsible for assigning email addresses for the respective domain. |
| DRAWING and NOTIFICATION OF POTENTIAL WINNER: |
| One (1) potential winner will be selected at random from among all eligible entries received during the Contest Period. Sponsor, whose decisions as to the administration of the Contest and the selection of the potential winner are final, will conduct the drawing. The potential winner will be notified by US postal mail within five (5) days of the drawing. In order to claim his/her prize, the potential winner must, except where prohibited, return to Sponsor, within ten (10) days of being notified, (1) a signed affidavit of eligibility and liability/publicity release and (2) a copy of the confirmation email received after entry in the winning Contest. If a potential winner cannot be contacted within seven (7) days after the first attempt to contact him/her or if he/she fails to return the signed affidavit and release and the confirmation email within the required time period, an alternate entrant will be selected in his/her place at random from among all eligible entries received during the Contest Period. If a winner has not reached the age of majority in his/her home state, then the prize will be awarded in the name of his/her parent or legal guardian and such parent or legal guardian will be required to execute and return the required documentation. Potential winner must comply with all terms and conditions of these Terms and Conditions and winning is contingent upon fulfilling all requirements. |
| PRIZE: |
| The prize is a $10,000 Scholarship which must be used for your own education, to pay off student loans or to give to a family member for use in connection with his or her educational expenses. No substitution or assignment of prize permitted, except by Sponsor, who reserves the right to substitute a prize with another of comparable or greater value. All taxes and other fees associated with prize receipt and/or use are the responsibility solely of winner. Odds of winning depend on the number of eligible entries received. |
| PUBLICITY: |
| Acceptance of any prize shall constitute the winner's consent to Sponsor's use of the winner's name, likeness, voice, opinions, prize information and hometown and state for promotional purposes in any media, worldwide, without limitation and without further payment or consideration, except where prohibited by law. |
| RELEASE AND LIMITATIONS OF LIABILITY: |
| By participating in the Contest, entrants agree to release and hold harmless Sponsor, its officers, directors, employees, affiliated companies and agents (collectively, the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers or telephone or network lines; (c) printing errors; (d) errors in the administration of the Contest or the processing of entries; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt of any prize, including but not limited to property damage, personal injury and/or death arising out of participating in this Contest, or the acceptance, possession, use or misuse of prize and claims based on publicity rights, defamation or invasion of privacy. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering the Contest, and in no event shall the Released Parties be liable for attorneys' fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved under the laws of the State of New York, without respect to any conflict of law issues, and entrant agrees that such shall be resolved individually, without resort to any form of class action, and exclusively by the U.S. Federal and State Courts of New York, New York. |
| GENERAL CONDITIONS: |
| If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Contest. Sponsor reserves the right to cancel, suspend and/or modify the Contest if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any person it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in a disruptive manner. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that or of any other provision. |
